 Attorney Noah Scott Warman supports Employee Free Choice Act in the Miami Herald

On September 22, 2008 Noah Warman published an editorial in the Miami Herald in support of the Employee Free Choice Act, responding to critics' arguments that elections must be required in order for a union to be recognized.  Noah explained that under the Employee Free Choice Act if a majority of workers sign up to have a union represent them, then their employer must recognize and bargain with the union.  The current system instead allows employers to insist an an election in order to delay union recognition and try to change the workers' minds.  The full editiorial is available at the following link:

Attorney Ivelisse Berio LeBeau speaks at ABA Section of Labor and Employment Law CLE Conference in Denver, CO

On September 11, 2008 Ivelisse Berio LeBeau spoke at the American Bar Association's Section of Labor and Employment Law Annual CLE Conference as a member of the Employee Benefits Committee.  This national conference brings together attorneys practicing in all areas of labor and employment law for Continuing Legal Education programs.  Ivelisse spoke on a panel titled Age Discrimination in Employee Benefits, focusing on the Supreme Court's recent opinion in Kentucky Retirement Systems, et. al. v. EEOC , 128 S.Ct. 2361 (2008).  She discussed the Supreme Court's application of age discrimination theory to employee benefit plan design, noting that the Supreme Court's analysis gives greater flexibility to employee benefit plan sponsors to design retirement plans using a participant's pension status as a factor in determining eligibility for benefits.  Conference materials are available at the following link:

Attorney Ivelisse Berio LeBeau Speaks at ERISA Pension Investment Conference

On May 2, 2008 Ivelisse Berio LeBeau spoke to multiemployer plan trustees at the ERISA Pension Investment Conference held in Hilton Head, South Carolina.  Ivelisse explained to the trustees how new and proposed Department of Labor regulations concerning ERISA plan service provider compensation will likely increase fee transparency by requiring that service providers explain how they are receiving direct and indirect compensation.  She discussed the effect these new rules will have on ongoing fiduciary duties to prudently select and monitor service providers, as well as potential litigation concerns raised if service providers have misused plan assets, received excessive compensation, or provided services under conflicts of interest.
